Malta: what actually goes wrong

The setups that repeat in Malta, what the law here really says, and what to do if the police turn up. Plain, unhysterical, written for adults.

Malta is not a dangerous island and the risk here is not violence. It is the combination of a very small place and a very high proportion of people passing through: cruise season, stag weekends, language schools, three months of summer that behave nothing like the other nine. Paceville after midnight is its own economy, and the usual money problems live there rather than anywhere private. Agree the address and the hour in writing before either of you moves, and treat a last-minute change as a reason to stop.

The law where you are standing

Malta is abolitionist: selling sex in private between consenting adults is legal, and everything that makes it visible or organised is not. Chapter 9 of the Criminal Code, Article 248A and following, criminalises brothel-keeping, pimping and living off the earnings of another, with sentences up to two years. Loitering and soliciting in public are offences in their own right, which is why nothing here happens on a street. Involving a minor carries up to six years. The island is small enough that discretion is not a preference but a practical necessity, and small enough that a profile which cannot be checked is a profile nobody local will vouch for.

Almost nothing here is exotic. The same four or five scripts run in every city in Europe, and the only reason they still work is that men who feel embarrassed do not compare notes.
